Certified Forklift Driver

This means the individual has completed a safe handling forklift training program and certified as a forklift driver. This certification indicates that the person has been trained in the safe and proper operation of forklift.

A certified forklift driver in Malaysia cannot drive a forklift on public roads. Certified Forklift Driver is meant to be operated only within designated industrial or warehouse areas. To legally drive a forklift on public roads, one would need a Class “F” or “H” tractor license, which covers the operation of tractors and forklifts on roads.

The certification is usually valid for a certain period (often two ~ 3 years), after which the operator needs to undergo refresher training.

Licensed Forklift Driver

In Malaysia, there isn’t a specific “forklift driver’s license” like there is for cars. Instead, forklift operators typically hold a Class “F” or “H” license, which is actually a type of tractor license. To obtain this license, one must pass a test that includes both theoretical and practical components.

In summary, a certified forklift driver has completed specific training and received a certificate, while a licensed forklift driver holds a Class “F” or “H” tractor license.

Operating a forklift without proper training and certification could lead to serious legal consequences, including fines and penalties, under the Occupational Safety & Health Act (OSHA) in Malaysia. Here are some key points:

  • Violation of Occupational Safety and Health Act 1994 (OSHA 1994): Operating a forklift without proper training is a violation of OSHA 1994, which mandates that employers ensure the safety and health of workers. You could be held liable for any injuries or damages resulting from the accident.
  • Employer’s Liability: Your employer could also be held liable for not providing the necessary training and certification. Employers are required to ensure that all employees operating machinery have the appropriate qualifications and training.
  • Legal Penalties: Both you and your employer could face legal penalties, including fines and legal action, if it is found that the accident occurred due to the lack of proper training.
  • Compensation Claims: Victims of the accident (whether employees or third parties) could file compensation claims against you and your employer for any injuries or damages sustained
